Sen. Jeff Chapman of Brunswick, joined by others including Tommie Williams, Greg Goggans, Jim Whitehead, Chip Pearson and others have introduced a bill that is at direct cross-purpose to SB 5, in that it prohibits taking private property for the purpose of conveying it to another private party. This is a smart move by this group, countering the incredibly bad publicity SB 5 has fetched in over the last few days. Who would have ever thought that the Sierra Club would have Neal Boortz beating a bill for it? SB 86 also prohibits condemning land “for the purpose of improving the tax base, or for the purpose of economic development.” An eloquent zinger in the bill: “However, it is the intent of the General Assembly that the private property rights of residents and businesses should be protected over the interests of private developers and corporations.” This is a fine piece of legislation that provides protection to property and the environment at the point where ordinarily those two related interests have been left in the dust and mud of economic development. The day when enemies of environmental protection have been able to use property rights against that cause is nearing its sunset.
